Plei is owned and operated by Plei, Inc, a Delaware corporation (“Plei”, “We”, “Us”).

Plei values your privacy and the protection of your personal data. This privacy policy (the “Privacy Policy”) describes what information we collect from you, how we collect it, how we use it, how we obtain your consent, how long we retain it in our databases and, if necessary, with whom we share it. This Privacy Policy applies generally to Plei’s website: https://www.plei.app/, mobile app, and any other related websites, forums, chatrooms or blogs (collectively, the “Site”) as well as Events (as defined below).

By accessing, registering and/or using the Site or participating in an Event, you (“User”, “You”) are hereby acknowledging and accepting that you have read, understand and agree to comply with the terms set forth herein. You further consent to the collection, storage, use and disclosure of your personal information as described in this Privacy Policy. Additionally, by using the Site, you agree to Plei’s Terms and Conditions (may be accessed at https://www.plei.app/terms)(the “Terms”), which govern your use of the Site and its services and attendance at Events.  

Plei reserves the right to modify content on the Site and this Privacy Policy periodically without prior notice. Any changes will become effective upon posting the changes, modification, or revisions to the Site, along with the date on which it was most recently updated as indicated by the “Updated as of” date set forth above. Your continued use of the Site and/or participation in any Event(s) after we make changes is deemed acceptance of those changes, so please check the policy periodically for updates.

2. TYPES OF INFORMATION GATHERED

‍The information we collect from our users helps us to deliver our services effectively and to personalize and continually improve the user's experience on the Site. These are the types of information we collect:Information You Give Us. You provide information when you (i) provide, search, read and view content on the Site, (ii) register as a user on the Site, (iii) join a game, match or other type of event coordinated through the Site or otherwise organized, operated, sponsored or hosted by Plei or its Partners (each, an “Event”), or (iv) use the functionalities available on the Site and/or communicate with us through our contact information or contact forms.  Plei’s partners, sponsors, facilities or other third parties that Plei collaborates with are referred to as “Partners”.  As a result of those actions, you might supply us with the following information:

• Name
• Email address
• Phone number
• Date of birth
• Gender
• Nationality
• Skill level
• Profile picture
• Any additional information relating to you that you provide to us directly or indirectly through our Site or online presence such as 'cookies’.

Plei will not collect any personally identifiable information about you, unless you provide it (including at or in connection with Events). We limit our data collection to only what is necessary for the stated purposes outlined in this policy.Information Collected Automatically: By accessing and using the Site you automatically provide us with the following information:

If you access the Site through a mobile phone, we will collect the following information:

Payment Information: Your payment data will be processed by the payment processors available on the Site (Stripe), which will process and store your data securely and for the sole purpose of processing transactions within the Site. Plei reserves the right to engage any payment platform available on the market, which processes your data for the sole purpose of processing transactions within the Site.See Stripe's privacy policy here:

Location: We store real-time information about the location of users registered on the Site when they use some features available on the Site, accessing the GPS function built into the mobile devices of each user. This information is stored to facilitate the correct use of the application and provide specific services based on the user's location. However, this information does not intentionally identify or individualize the person. The user can request the removal of such information, but certain functionalities of the Site would not be available. Location information collected through the Site will be treated in accordance with this Privacy Policy.GOOGLE Analytics. We use Google Analytics provided by Google, Inc., USA (“Google”). These tools and technology collect and analyze certain types of information, including IP addresses, device and software identifiers, referring and exit URLs, feature use metrics and statistics, usage and purchase history, media access control address (MAC Address), mobile unique device identifiers, and other similar information via the use of cookies. The information generated by Google Analytics (including your IP address) may be transmitted to and stored by Google on servers in the United States. Plei Events: If you participate in Events, we may capture your image and/or voice by photograph, audio or video recording and you may be subject to additional terms regarding media release, data collection, and information sharing. Please refer to our Events Terms and Conditions for detailed information.  We may use your Likeness (as defined in Events Terms and Conditions) as described in this Privacy Policy.

HOW LONG WE KEEP YOUR DATAPersonal data provided by users through the Site will be kept for the time necessary to provide the functionalities available on the Site, until the user decides to close its account or until Plei closes and deletes the user’s account. Plei may retain personal data for a longer period where the user has given consent to such processing, provided that such consent is not withdrawn. In addition, Plei may be obliged to retain personal data for a longer period if this is necessary for compliance with a legal obligation or by order of an authority. Once the retention period expires, the personal data will be deleted. Therefore, the right of access, the right of erasure, the right of rectification and the right to data portability cannot be asserted once the retention period has expired. Your Likeness will be kept until the legitimate interest of Plei and its Partners of the respective Events lasts. 4. HOW WE USE YOUR INFORMATION (PURPOSE AND LEGAL GROUNDS). In general, we use the information we collect primarily to provide, maintain, protect and improve our Site, Events and services, as further described below, based on below stated legal grounds:

• Provide the Site, available on Google Play and App store (based on contract between you and Plei).
• User registration (required to enter into a contract).
• Provide the functionalities available on the Site (based on contract between you and Plei).
• Provide access to Events coordinated through the Site (based on contract between you and Plei).
• Process transactions (based on contract between you and Plei).
• Improve our Site (Plei’s legitimate interest).
• Understand and enhance your experience using our Site (Plei’s legitimate interest).
• Respond to your comments or questions through our support team (based on contract between you and Plei and Plei’s legitimate interest).
• Send you related information, including confirmations, invoices, technical notices, updates, security alerts and support and administrative messages (based on contract between you and Plei and Plei’s legitimate interest).
• Sending notifications and other messages via SMS messages (based on contract between you and Plei and Plei’s legitimate interest).
• Communicate with you about upcoming Events, offers and news about products and services offered by Plei and our selected Partners (legitimate interest of Plei and Partners, if applicable).
• Marketing purposes of Plei (Plei’s legitimate interest).
• Link or combine your information with other information we get from third parties to help understand your needs and provide you with better service, while we do not profile you (Plei’s legitimate interest).
• Protect, investigate and deter against fraudulent, unauthorized or illegal activity (Plei’s legitimate interest).

We use your Likeness to for marketing purposes and to utilize your release and authorization under the Events Terms and Conditions (Plei’s legitimate interest).You provide your personal data voluntarily, but without providing them, you may not be able to use our services or to participate in the Events.

5. HOW WE SHARE INFORMATION

‍The personal information of our users is an important and fundamental part of our business. Under no circumstances will we sell your information. We share your information as necessary to provide the Site and Events, as required by law, or as part of our business practices as described below. Plei Partners and Event Sponsors. We engage with several Partners, such as Event sponsors. We may share information with them to provide and support our Events, and to conduct our marketing activities. For EU-based Events, the Partners are communicated in relation to the Event, and they act as co-organizers of the Event and process your personal data as a separate data controllers. Please refer to privacy policies of those Partners. Third-Party Service Providers. We use third-party services to perform certain functions on our behalf and through our Site and in relation to the Events. Examples of these third-party services include: creating and hosting the Site, processing payments (Stripe), sending emails, analyzing data (Google Analytics), marketing assistance, and delivering search results. Some Event Partners can act as our providers and we may share your data with them in that connection. These third-party providers, services and tools may have access to personal information needed to perform their functions, but may not use that information for other purposes. Information shared with these third-party services will be treated and stored in accordance with their respective privacy policies and our Privacy Policy. Business Transfers. In the event that Plei creates, merges with, or is acquired by another entity, your information will most likely be transferred. Plei will email you or place a prominent notice on our Site before your information becomes subject to another privacy policy.Protection of Plei and others. We release personal information when we believe a release is appropriate to comply with the law, enforce or apply our Terms and Conditions and other agreements, or protect the rights, property, or safety of Plei, our users or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.With Your Consent. Other than as set out above, you will receive notice when personally identifiable information about you might go to third parties, and you will have an opportunity to choose not to share the information.  Anonymous Information. Plei uses the anonymous browsing information collected automatically by our servers primarily to help us administer and improve the Site. We may also use aggregated anonymous information to provide information about the Site to Parters. This information is not personally identifiable.Email Address. The email address that you supply to us for purposes of receiving our email communications will never be rented or sold to a third party.If you reside in EU, UK or Switzerland, be informed that we transfer your personal data into the U.S. based on available transfer frameworks, in particular based on EU-US adequacy decision.

‍6. PROTECTING YOUR INFORMATION

‍We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you provide through the Site. If transactions are processed on the Site, transaction information is transmitted to and from the Site in encrypted form using industry standard SSL connections to help protect such information from interception. We restrict authorized access to your personal information to those persons who have a legitimate purpose to know that information and to those persons you have authorized to have access to that information. Plei follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once Plei receives it. However, as you probably know, no website, application or software can fully be protected from malicious software and other “hacking” activities, and third parties may unlawfully intercept, or access transmissions or private communications and other users may abuse or misuse your personal information that they collect from the Site. Therefore, although we work hard to protect your privacy, we cannot guarantee that your personal information or private communications will always remain private.‍

‍7. RIGHTS

‍Users who provide information through our Site, as data subjects and data owners, have the right to access, rectify, download or delete their information, as well as to restrict and object to certain processing of their information. While some of these rights apply generally, others apply only in certain limited circumstances. We describe these rights below:

• Access and portability: to access and know what information is stored in our servers, you can send us your request through our contact information.
• Rectify, Restrict, Limit and/or Delete: You can rectify, restrict, limit or delete most of your personal information by logging into your account at Plei. Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts in order to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions, and take other actions otherwise permitted by law.
• Right to be informed: Users of our Site will be informed, upon request, about what data we collect, how it is used, how long it is retained and whether it is shared with third parties.
• Object: When we process your information based on our legitimate interests as explained above, or in the public interest, you may object to this processing in certain circumstances. In such cases, we will stop processing your information unless we have compelling legitimate reasons to continue processing it or where it is necessary for legal reasons.
• Revoke consent: Where you have previously given your consent, such as to allow us to process and store your personal information, you have the right to revoke your consent to the processing and storage of your information at any time. For example, you may withdraw your consent by updating your settings. In certain cases, we may continue to process your information after you have withdrawn your consent if we have a legal basis for doing so or if your withdrawal of consent was limited to certain processing activities.
• Complaint: If you wish to file a complaint about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority. • Rights related to automated decision-making, including profiling: We generally do not use your data for automated decision-making, including profiling. But users may request that we provide a copy of the automated processing activities we conduct if they believe that data is being unlawfully processed.

Users or owners of the personal information they provide through the Site may exercise these rights over their personal information at any time and without any limitation by sending us their request through our Support Email.

‍We use cookies and browser local storage (small files placed on your hard drive) on certain pages of the Site to help analyze our web page flow, customize our services, measure promotional effectiveness, improve functionality and preserve and track transaction history and information between sessions. ‍9. CHILDREN’S ONLINE PRIVACY PROTECTION

‍Our Site is directed toward and designed for use by persons aged 13 or older. We do not collect any information from children under the age of 13. We will not approve applications or establish or maintain registrations for any child whom we know to be under the age of 13. We do not solicit or knowingly collect personally identifiable information from children under the age of 13. If we nevertheless discover that we have received personally identifiable information from an individual who indicates that he or she is, or whom we otherwise has reason to believe is, under the age of 13, we will delete such information from our systems. Additionally, a child’s parent or legal guardian may request that the child’s information be corrected or deleted from our files by requesting this via our Support Email.

‍10. MARKETING MATERIALS

‍By providing Plei with your personal data, you agree that we may use your email address to send you notifications about Events, important communications about our services, news, and special content. We may also use your phone number to send you notifications via SMS messages, push notifications, and other messages related to Events offered through the platform, news, and relevant communications or content. If you do not wish to receive these emails, SMS messages, or push notifications, you may opt-out of receiving them by sending us your request through our contact information or by using the "unsubscribe" option in emails, or by replying with the word "PAUSE" to SMS messages. Opting out may prevent you from receiving match-related emails, SMS messages, and push notifications.

‍11. ACCOUNT SECURITY

‍You are responsible for the access to your account. If you share access to your account with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your account, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if access to your account has been compromised for any reason, you should immediately notify Plei.

‍12. DISCLOSURE TO THIRD PARTIES

‍Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information Plei collects from you. If you disclose your information to others, whether other Plei users or Partners, different privacy policies or rules may apply to their use or disclosure of the information you disclose to them. Plei does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. Plei is not responsible for the privacy or security practices of other websites, including those that are linked to from Plei.

‍13. CHANGES IN THIS PRIVACY POLICY

This Privacy Policy will remain in effect until you cease to use the Site and attend Events.  Notwithstanding the foregoing, all terms and conditions of this Privacy Policy that may require continued performance, compliance, or effect beyond the termination date of this Privacy Policy will survive termination of this Privacy Policy and will be enforceable by the parties. We may also terminate, modify or amend this Privacy Policy at any time and may do so immediately without notice (provided that registered users will be given fifteen (15) days prior notice of changes to this Privacy Policy), and accordingly deny you access to this Site and Events, if in our sole discretion, you fail to comply with any term or provision of this Privacy Policy. Upon any termination of these Terms, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as copies of such materials, whether made under these Terms or otherwise, unless otherwise permitted by separate written agreement with us.
